Miracle Adoption is a second chance any orphan child would dream of, and for the person or people adopting the child it is a great chance to form that miracle family any person would want. Their whole life will turn around in a 360 motion and it is a big deal. It is an opportunity that should be taken seriously, and the adoptive parents should do research before having a child in their care. Each child is unique and has a different background story. Roe V Wade and Doe V Bolton Free Essays

Both of these cases were ruled on at the same time. Both cases resulted in landmark decisions that would change how many states were allowed to regulate abortion. These rulings also help put into view the line between law and morals. Roe v Wade Jane Roe† was actually a pseudonym for the plaintiff, Norma McCorvey. She used this for protection and also to emphasize that she was fighting for all pregnant women. The defendant was Henry Wade, district attorney for Dallas County, Texas. McCorvey’s claim was that the Texas abortion law, passed in 1859, violated her constitutional rights. Backstory: Norma McCorvey, age 21, became pregnant in 1969. She did not want to continue with her pregnancy, as her marriage had failed and her first daughter was in the care of her mother and stepfather. As previously stated, Texas passed a law in 1869 preventing all abortion, excluding cases in which the woman’s life was in danger. She met Sarah Weddington and Linda Coffee, two attorneys who were interested in changing the abortion law. There were two issues standing in the way: McCorvey might not have standing because the abortion law only applied to women who performed abortions, not to those who needed them. The second issue was if she passed the point in her pregnancy where it was safe to perform an abortion, the case would become irrelevant. Their argument: in a previous case, Griswold v Connecticut, Justice William O. Douglas interpreted the Ninth Amendment to mean that any rights not explicitly granted to the government were retained by the people; previously it had been taken to mean that those rights were retained by the states. At the time of this case, this meant that all previously banned contraceptives between couples were now legal. Weddington and Coffee could argue that this â€Å"right to privacy,† as Douglas defined, should also be applied to abortion. The first reply from Assistant D. A. John Tolle, defending D. A. Wade, claimed exactly what they had expected: â€Å"Jane Roe† had no standing since the law only affected women who performed abortions. An anonymous affidavit from McCorvey submitted to a three-judge panel on May 22, 1970, stated that she wanted to terminate her pregnancy due to â€Å"the economic hardship which pregnancy entailed and because of the social stigma attached to the bearing of illegitimate children. At the hearing, Weddington argued on Roe’s standing to sue, as well as the constitutionality of the abortion statute (on the grounds of the First, Ninth, and Fourteenth Amendments). After the defense argued for the unborn fetus as a child, a life, Weddington brought up the issue of the impossibility to define when â€Å"life† begins (which is still one of the main arguments between pro-life and pro-choice advocates). Finally, Tolle argued that right of a child was more important than the w oman’s previously stated â€Å"right to privacy. However, the three judges found that the Texas abortion laws were unconstitutional by depriving rights dictated by the Ninth Amendment. Since this only declared the law unconstitutional and did not prevent the enforcing of the law, the plaintiffs then appealed to the Supreme Court. In October 1972, the plaintiffs and the defendants made their cases as they had before. Several things played into the Court’s following decision: the ruling of Eisenstadt v Baird, which made it legal for unmarried persons to use birth control. This solidified Weddington’s argument for the right to privacy in the Ninth Amendment; that individuals have the right to be free from government intervention in matters such as whether or not to have a child. Second, Justice Harry Blackmun, after reviewing the abortion statutes, ruled that they were no longer valid because they were put in place due to the dangers of abortion; this was no longer an issue, as abortion was just as safe as childbirth in the present time. Concerning the rights of the unborn as a child, Blackmun found that nowhere in the Constitution or Bill of Rights (specifically, the Fourteenth Amendment) a â€Å"person† includes the unborn. The final ruling: the abortion decision must be left to the judgment of the woman’s doctor in the first trimester. In the second trimester, the state may â€Å"regulate the abortion procedure in ways that are reasonably valid to maternal health. † After that, the state can regulate or stop the abortion. Summary Norma McCorvey wanted an abortion, but could not obtain would since it was illegal in her state, Texas. Most states at the time had abortion statutes in place proscribing abortion. She, under the alias â€Å"Jane Roe,† and the two attorneys representing her, Sarah Weddington and Linda Coffee, filed a suit against the county of Dallas on the grounds that the abortion laws violated a woman’s right to choose under the â€Å"right to privacy,† interpreted in the Ninth Amendment in the previous case Connecticut v Griswold. The district court ruled in favor of â€Å"Roe,† basing judgment upon the Ninth Amendment. This ruling did not prevent the enforcement of the abortion laws; rather, it merely stated that they were unconstitutional. McCorvey and her attorneys, now not only representing â€Å"Jane Roe† as a person, but as all women, appealed directly to the Supreme Court. On the opposing side, there was the fact that the state believed they had the responsibility to protect the life of the unborn child. The argument against that was this: â€Å"when does life really start? † It could be said that life doesn’t begin until after the child is born; not when it is still a fetus. This really sparked this debate that still goes on today. Justice Harry Blackmun found that, after reviewing the Constitution and Bill of Rights, the Founding Fathers never explicitly put the unborn with the â€Å"persons† protected under our nation’s documents. However, he said that this was not absolute. He said that, though he agreed that the Ninth Amendment encompassed a woman’s right to choose whether or not to terminate her pregnancy, the right to choose was also not absolute. So, they came to a compromise: during the first trimester of a pregnancy, abortion was legal, but at the judgment of the woman’s doctor (which has changed since then). During the second trimester, the state could regulate abortions in a way that is related to maternal health. During the third trimester, the state could proscribe abortions. The general rule was that if the fetus is able to live outside the womb (with artificial aid), which was typically at about 28 weeks, then the woman no longer has a right to an abortion. This entire case and the decisions that were made is a landmark in our history. It has sparked much debate and divided many people into â€Å"pro-life† and â€Å"pro-choice† groups. Doe v Bolton A companion case to Roe v Wade, Doe v Bolton was an abortion case that happened in Georgia around the same time (decision on the same day) that its Texas counterpart did. Much like other states with abortion laws, Georgia only allowed abortion if: the pregnancy was a danger to the woman’s life by judgment of a licensed physician, the fetus was in danger of being born with a serious defect, or if the abortion was a product of rape ( § 26-1202(a)). The woman wanting an abortion also had to qualify for the following conditions, defined under  § 26-1202(b) of Georgia Criminal Code: â€Å"the abortion [is to] be performed in a hospital accredited by the Joint Commission on Accreditation of Hospitals, the procedure be approved by the hospital staff abortion committee, and the performing physician’s judgment be confirmed by independent examinations of the patient by two other licensed physicians. † Sandra Cano, a mother of three, did not meet any of these conditions. Under the pseudonym â€Å"Mary Doe,† she and her attorney, Margie Pitts Hames, sued Arthur K. Bolton, the Attorney General for Georgia. Their claim was that the abortion statute of Georgia was unconstitutional. Like â€Å"Roe,† the three-judge panel of the district court found that Doe did, in fact, have standing in this issue. They ruled that the first three conditions ( § 26-1202(a)) listed above were unconstitutional, but they upheld the medical approval and residency requirements. In addition, like Roe v Wade, they merely provided that the section of the law was unconstitutional; they did not give any injunction against enforcing the law. This is called declaratory relief. The plaintiffs then appealed directly to the Supreme Court, like Roe and her attorneys. The arguments and counter-arguments were all the same as in Roe v Wade. The Court found that the three conditions in section 26-1202(b) were unconstitutional. They found that the JCAH accreditation requirement did not pertain to the woman’s right, and did not reasonably relate to the abortion statute. The two conditions requiring the abortion to be approved by a committee and by two other physicians were found to not serve the woman’s health in any way. The committee condition violated the woman’s â€Å"right to receive medical care† from her physician, and the two-doctor condition violated the physician’s â€Å"right to practice. † These conditions were struck down. Justice Blackmun, mentioned in the previous case, said that Roe v Wade and Doe v Bolton must be read together. The former allowed the states to proscribe abortion in the third trimester. However, Doe v Bolton added that the abortion could still be allowed if it was a matter of the woman’s health, in the opinion of the woman’s doctor. This is essentially a loophole around the â€Å"viability† requirement of the ruling of Roe v Wade. Doe v Bolton and Roe v Wade together struck down state abortion laws and struck up heated debates. These were the first real challenges regarding abortion in the United States. Both declared abortion a constitutional right. Summary Sandra Cano (â€Å"Mary Doe†) and attorney Margie Pitts Hames sued the state of Georgia for its unconstitutional abortion statute. The district court found they had standing, but like Roe v Wade, they gave them only declaratory, not injunctive, relief. The plaintiffs appealed to the Supreme Court for broader relief. Georgia’s Criminal Code, section 26-1202(b), stated that in addition to the requirements to receive an abortion that a woman must be in danger from the pregnancy, the child must be in danger of severe defect from birth, or the pregnancy being a result of rape, any woman wanting an abortion had to receive one in a hospital accredited by the Joint Commission on Accreditation of Hospitals, she had to receive permission of two physicians other than her own, and the decision must also be approved by a hospital committee. The Court struck all of these requirements as unconstitutional. Additionally, the Court ruled that a woman may obtain an abortion after â€Å"viability† (as defined in Roe v Wade) if it was necessary to preserve her health. My favorite entrepreneur: Ms. Oprah Winfrey Oprah Winfrey was born into poverty by a teenage single mother in 1954 in Kosciusko, Mississippi. For the earliest years of her life she was raised by her maternal grandmother, and under her kind-hearted discipline was taught to read by the age of two and speak exceptionally by the age of three. When Winfrey was six years old, she was sent to live with her mother in Wisconsin. She was submerged into inner-city Milwaukee, and faced the hardships of growing up in the urban ghetto. Her mother had many problems of her own and was so consumed by them that she was unable to give attention to her daughter. This had many adverse consequences, and left Winfrey vulnerable to multiple counts of sexual abuse at an early age, including by her mothers boyfriend, a teenage cousin, and a family friend. She also became pregnant at the age of 14, but her son died at infancy. However, it was hard for her to contain her emotions on many of her stories, and her attachment to the subject matter made her a poor fit for the position. She was fired for these reasons. Nevertheless, a manager at the network saw her ability to connect closely with the subjects and her excellent communication skills and found a position more suited towards her as a co-host on talk show People Are Talking. The show’s ratings soared, and Winfreys success attracted attention in the Midwest where she was offered a position as anchor on AM Chicago. It almost instantly became the #1 local talk show and within a year was renamed the Oprah Winfrey Show. The show was soon picked up in 120 cities and became the nation’s top talk show. However, Winfrey did not like the idea of working for someone else, and in 1986 she founded Harpo, Inc. and took on the Oprah Winfrey Show by 1988 in her own studio in Chicago. The third woman in history to own and produce her own show, as well as the first African-American to own her own entertainment production company, Winfrey was capitalizing success. Tourette Syndrome I have been intrigued by this disorder since I met a beautiful little girl named Sarah. Sarah's father recently told me that doctors have informed him that Sarah may have Tourette Syndrome. I had visions in my mind of a little girl shouting profanity uncontrollably with arms flailing about, although the times that I have been with Sarah have never been marked by these actions. I set out to find more information to satisfy my own curiosity and to make myself a resource for Sarah's father. Tourette Syndrome (TS) was first officially described over 100 years ago by a French neurologist named Gilles de la Tourette, a pupil of Charcot's and a friend of Freud's. He described nine patients, primarily Madame de Dampierre, by saying: At the age of 7 (she) was afflicted by convulsive movements of the hands and arms. . . She was felt to be suffering from overexcitement and mischief, and . . . she was subjected to reprimand and punishment. It soon became clear that these movements were indeed in voluntary. . . involved the shoulders, the neck, and the face, and resulted in contortions and extraordinary grimaces (1). Soon after the motor tics developed, Dampierre developed vocal tics consisting of screams and cries. Until her death at 85, she was forced to live in seclusion (2). Between 1920 and 1960, TS was all but forgotten, and psychiatrists and psychoanalysts treated the symptoms as suppressed aggression, which proved ineffective (1). When drugs such as haloperidol were able to alleviate symptoms in the 1960's, however, Giles de la Tourette's initial observations were reevaluated. Discrimination Complaint

Many employees, especially in America are faced with discrimination either in schools or in work places. The case at hand is about John. He, being a federal employee files a discrimination complaint with the Equal Employment Opportunity Commission (EEOC) against his employer, who heads the agency he is working for. He takes this initiative because as per the Code of Federal Regulations, each employee has a right to file complaint for an equal employment opportunity with the agency.A charge filed with EEOC will also automatically be filled with Fair Employment Practices Agencies (FEPAs) since they work hand in hand to avoid effort doubling-up of charge processing. Moreover, it is determined within a short period of time (EEOC, 2009). In John’s case, since he is the aggrieved person, prior to his the case filing, he will first consult with an Equal Employment Opportunity (EEO) officer in an attempt to decide the discrimination matter casually. During the forty five days EEO proc ess, John is mandated to have his own representative, probably an attorney.During this period, the counselor should be neutral to both the employer agency and John. The counselor will offer John a variety of the available legal choices. After having gone through his rights and responsibilities list provided by the counselor, John has to raise a counseling matter; otherwise the formal EEO complaint is discharged. If a concrete resolution is not realized, then this paves way for the aggrieved person, in this case John, to file a formal EEO complaint with a federal district court.This is because all the available administrative remedies have been exhausted. However, before John can file a formal complaint, he must have received a notice of final interview from the EEO counselor. Moreover, he must be provided with an apposite official of his employer agency. The right to file a formal complaint has to be effected within Fifteen days after receiving the aforementioned notice (Bernnett & Hartman, 2007). When John is filing this complaint in person, he has to go to the meeting with any papers or information that will aid the EEOC figure out his case.This may include a letter or notice indicating his performance evaluations and also that he was kicked out of the job. Moreover, he will bring with him names of fellow employees, who have sufficient information of what went on with their contacts included. On the other side, he can send a letter containing his personal details, the employer’s details, a brief explanation of the proceedings that he believes were bigoted, the date when these discriminatory events took place and the number of the employees in the company.The inequitable dealings have to be unambiguous, for instance, John has to state whether he was fired, harassed or demoted. Additionally, he has to give the reasons as to why he believes he is facing discrimination such as sex, religion, genetic information or even age. Importantly, John has to make s ure that he signs his letter to give EEOC the go-ahead for investigations. This information is assessed and a follow up questionnaire may be sent to John if additional information is required from him. John has to be timely and follow the aforesaid EEOC procedures so as to avoid from being dismissed off his complaint.Later on, the information is got into in a certified EEOC charge form. Both John and his lawyer are conducted to sign the form. In the acknowledgement letter issued to John by his employer, he (the employer), will be required to indicate the EEOC office’s address in which the complaint is to be heard, the time that the employer requires to conduct an appropriate and impartial investigation of the complaint filing by John and the employer’s right to appeal to the ultimate pronouncement arrived or dismissal of John’s grievance.In case John has more similar claims over or related to those of the earlier pending complaint, he has the mandate to add the same. This is referred to as amendment of the pending complaint. For John to be in a position to amend the complaint, he must write a letter addressed to the EEO director of his employer. In this letter, John has to explicitly give detailed information about the new occurrence(s). Furthermore, he is entitled to affirm his intend to amend the complaint by including the new incidents.On receiving the letter, John’s employer or his EEO director will carefully assess the amendment request with the aim of determining the handling correctness of the complaint amendment. However, if John’s existent claim offers adequate support to the additional claims and does not birth a new claim or if the arising claim is closely related to the former, there is no need for a new EEO counseling. John’s new claims qualify to be part and parcel of the investigation and the same is communicated to him.A comprehensive and inclusive investigation of John’s employer then commences. This ought to be developed without prejudice and must be factual in all its recordings. The aim of it being factual and impartial is to ensure that the conclusions to be drawn at the end will be reasonable as to whether John was discriminated by his employer or not. During this process, the investigators are consented to with oaths administrations, witness testimonies and proper documentation. Moreover, they must not have a conflict of interests with the aggrieved party during their investigation.Besides, they should congregate pertinent substantiation that will be employed as a fact-finder in determining whether or not the employer had been involved in a discriminatory act against John. Once the investigation process is over, the employer will provide John with a copy of file in which the complaint had been recorded, the investigation report and the notice of the right to ask for either the on the spot employer’s final decision or an EEOC hearing. The federal district court thus, after the EEOC resolves to file a civil action, handles John’s discrimination complaint entirely as a new case.Moreover, the assumption that arises is that no findings were conducted by the EEOC. The principal purpose behind the court’s take to handle the case as above mention is to ensure that no biasness during the process of issuing a judgment (Cornell, 2009). Moreover, new and more thorough investigations take place. Irrespective of EEOC denying John a right-to-sue-letter, he still bears this right to file a court case. So long as EEOC helps protect employees from prejudice, the surety that he will receive a right-to-sue letter from the EEOC is only he is in a position to substantiate the earlier mentioned bases of discrimination. War literature presents the modern reader with peoples experiences from the period. Their views are integral in shaping our own opinions on war. Although war literature often differs in its composition, many themes are concurrent throughout the genre. All Quiet on the Western Front by Remarque and Testament of Youth by Vera Brittain, both portray the theme of futility of war. They are both drastically different in their portrayal, one an account from a German soldier and the other, an autobiography by a British woman; the ideas that they present on how war is futile presents a human wide consciousness of its futility and begs the readers to question the human nature of declaring and fighting war. The First World War was dubbed the war to end all wars but it did not end all wars as the name might suggest, rather it simply set the pattern for new and even more mechanised killing. Remarque thoroughly explores the impersonality of killing and the idea of a mechanised war in All Quiet on the Western Front. One way in which he presents this idea is through a very matter of fact approach to fighting and injury such as: Kat and Kropp even make another sortie during the afternoon. In the process Kropp gets an earlobe shot off. Vera Brittain also uses a matter of fact approach in her writing rather than romanticising the injuries she witnessed. It is likely that Remarques own experiences in the war heavily contributed to this novel; several of his other novels also dealt with the atrocities of the war and its aftermath. Injured by British shell-splinters at Passchendaele, Remarque witnessed first hand the brutality of war and hence this is a key theme throughout the novel. By presenting how brutal war was, he helps to destroy the false fai ade of the glory and honour of war and in a sense demonises the way in which it destroys the livelihoods of soldiers on the front and civilians back home. As a result, after the Nazis came to power, All Quiet on the Western Front was subject to their book burning. Vera Brittain also destroys the false faade of the glory and honour of war after she learns of the death of her fianci Roland. The loss of honour and glory is symbolised by Rolands returned kit. Notably, his badge, which would represent his honour and that of the army, was thickly coated in mud. He must have fallen on top of it, or perhaps one of the people who fetched him in trampled on it. This suggests that the honour that the badge represents has been soiled by the war, the badge now symbolises the horror of war without its glory. This is also ambivalent in the sense that she suggests he may have fallen on top of it, rather than just presenting how the war is no longer honourable it also suggests that there was no glory in his death and that his death and that death and destruction is what the war truly symbolises. Vera Brittain has altered the clichi of falling on ones sword to illustrate how the soldiers did not die traditional heroic deaths, but like her own fianci died for no military benefit. In addition, her reference of the returned kit as relics suggests that this is all that is left of her fianci  after the death and decay of the war. It represents her attitude towards the war, the return of the kit causes her realisation of all that France meant, that France meant death and destruction for both sides. It is however ambiguous as there is a level of conceit in all that France meant. She surprisingly compares France, which is often seen as cultural and beautiful, to death and destruction perhaps highlighting the idea that civilisation leans itself to war and that after this war is at end it will not be long until the next begins. This is a clever if not relatively elaborate way to express her view on the futility of war, that no matter what they say this war will not end all wars, it is a futile loss of life. Killing removes all honour and glory from both country and men and there shall be no benefit to either side on victory or loss because both ironically mean death. The frankness in which she portrays these ideas is of high importance, but it also unnerved many of the original reviewers. James Agate wrote that it reminded him of a woman crying in the street. One can see how he may have formed his opinion and it illustrates Brittains dramatic responses to the events yet I find him a little unjust in his criticism. Testament of Youth was the real book of the women of England1 and presents the strife of women during World War One. Virginia Woolf expressed the more widespread response, she mocked the story of how she lost her lover and the other clichi s of war literature, she admitted that much about the book had interested her and in turn had left its mark on her own novel The Years that had been influenced by Brittains connection between feminism and pacifism2. Remarque expresses the theme of brutality of war through his clever use of irony, such as in the first chapter. On the opening page of the first chapter, the protagonist narrates: We havent had a stroke of luck like this for ages. The men feel lucky for receiving a double ration yet this is due to the fact they lost a large amount of men because the English guns kept on pounding [their] position. This is both an example of verbal and structured irony, which is used extensively throughout the novel. It is first perceived that the double rations are what are lucky, but the death of half the platoon provides the luck. It is structured irony also, because the remainder of the platoon know they are lucky in receiving the extra rations due to the death of half of their platoon, yet they do not understand its significance. They have been immune to the concept of death to survive. The reader however is presented with mass carnage and the idea of other humans revelling in this stroke of luck. This depicts how the men have been dehumanised by the war; they revel in the death of their own kin because it helps to save their own lives. This irony is key in presenting Remarques view on how the war is futile. Imagery is another integral part in Remarques development of the theme of brutality of war and so how he presents war as being futile. Paul narrates, Its as if it is not the guns that are roaring; its as if the very earth is raging. The war has become so brutal and the killing so impersonal that it is no longer as if there are two sides fighting each other but more as if the earth is fighting humanity. Remarque is also careful to make sure the use of the word enemy is rare and instead Bi umer refers to the others, or to those over there. Vera Brittain is also hesitant to use the word enemy, instead stating that the men had been ordered to fire against the advancing Germans. This reinforces the idea that the earth is fighting humanity. Both sides are experiencing terrible losses and appalling conditions. Vera Brittain describes how she saw the hand of a man whod been killed only that morning beginning to turn green and yellow which demonstrates her use of imagery to graphically illustrate the horrors of war. The idea that both writers from opposing nations record the same details suggests that death itself is the enemy. If death itself is the enemy rather than the opposing side, the very fact that they are fighting is futile. There are no gains to either side, apart from the gain in numbers of death and casualties. Remarque also focuses heavily on the dehumanisation process of front-line soldiers, and remarks upon how all conventions of society lose their place in war in place of pure human instinct for survival. One such scene that demonstrates this is when Bi umer, Kropp and Mi ller use the latrines, they: pull three if them together in a circle and make [themselves] comfortable. It is quite a peculiar image of three men making themselves comfortable whilst in each others company using the latrines. It could be argued to be satirical, ridiculing how society acts in demonising and hiding natural parts of human life. However, I am inclined to believe that Remarque is hinting at how the soldiers have been dehumanised. Due to the loss of their social upbringing they will find it difficult to integrate back into society should they survive the war. This suggests that Remarque views the war as futile because even should the men survive they will not be in a position to live how they used to and in a sense have perished. Brian Murdoch, the translator and author of the afterword suggests that the novel presents the war without heroism but through terror and the loss of human dignity and values. This reinforces the idea that the dehumanisation of the soldiers is important in presenting the theme of futility of war. Whereas Remarque focuses heavily on the dehumanisation of men during the war, Vera Brittain concentrates profoundly upon the effects the war had at home through the themes of feminism and a prevailing sense of pacifism. Despite this, both Remarque and Vera Brittain focus on the effects on society by the war. Vera Brittain grew up in provincial comfort in the north of England, into a family that did not want her to follow her academic aspirations and so her experiences prior to the war evidently contribute to her feminist and pacifist ideology. She links her ideas of feminism to pacifism. Her aspirations to gain an education and then to work towards the war effort she had to confront her own susceptibility as a younger woman to the glamour of war. It became apparent that Brittain was ready to reject anything that identified war with grey crossed, and supreme sacrifices, and red poppies blowing against a serene blue sky. Both Testament of Youth and All Quiet on the Western Front, focus heavily on the theme of futility of war and as suggested by other critical appreciations of the texts, the focus on the novels concentrates heavily on illustration war without glory, without heroism. They both present death as the real enemy within war. Brittain focuses on the dismantling of the  ade of an honourable and glorious war, and invokes her feminist and pacifist ideology (much of what she forms after her experiences of the war) to demonstrate this. Whilst Remarque also illustrates how war is not glorious, his use of imagery and irony help to form images of how brutal war was and how it affected the lives of the young soldiers fighting in it. His assertion that his intelligence is the reason for his isolation must have some truth; that he should be so socially inept at his age is probably explained by his acute sensitivity, but it is interesting to think that it might also have been his isolation that has led to his extreme sensitivity. I, as I suspect almost everyone, have had feelings of alienation and isolation that, during the time of their occurrence, I could only have described as profound; although looking back these feelings become easier to rationalize and to see the cause of. But he insists in the fact that he is always rational, and that his intelligence is superior and furthermore correct. He knows that he is negative and destructive towards himself and others, but he makes no effort to resolve this. He seems disillusioned, but he is actually a pitiful victim of self-deception, attaching the wrong sort of â€Å"superiority† to his miserable intelligence, and believing himself superior to everyone else. When he says: â€Å"You know, ladies and gentlemen, probably the only reason why I think Im an intelligent man is that in all my life Ive never managed to start or finish anything† (p. 104), he means that only the stupid can be so sure of themselves; this is one thing that is irritating and frustrating about him. His intelligence has rendered him immobile because he is aware of all the uncertainty inherent in nature, and he will not believe that he has a full understanding of reasons, as the stupid man does. He finds comfort in justifying his plight by asserting that he is intelligent But in his portrayal of his â€Å"misadventures† in the second part of the story, I felt a distasteful sort of sympathy. One almost feels elated on his behalf, in the instance when he is almost joyous that he would at last have an â€Å"encounter with reality†: So this is reality, I mumbled, dashing downstairs, finally Ive met it head on. † (p. 159) At last a decisive event will happen in his life, one over which his excessive rationalizing has no effect. He hides from from life, and he feels alive only by being destructive. But in him one finds a sort of friend who will probably understand your every ill emotion because he has experienced it all, but who will also probably scorn you and make you feel foolish. His intelligence has allowed him – or perhaps has forced him – to live a life of constant rationalizing, thus robbing him of he ability to relate to the â€Å"lower† level of ordinary human life. But he is also subject to pride despite his intelligence. I could almost sympathize with what happened when he â€Å"did make a friend once, but I was already a tyrant at heart and wanted to be the absolute ruler of his mind. I wanted to instill in him contempt for all those around us; I demanded that he break with his world† (p. 147). I have had my share of instances of a vague sense of contempt for everyone, but I am far from rejecting society as he has. His rejection of society has led to society rejecting him, and this has robbed him of tangible experiences and made him desperate.

HRM Activities in Tesco In any organization, the most important asset is its employees though it may or may not be profit-oriented. So the most complicated task is to manage the human resource. Today, in the rapid advancement of technology, Human Resource is unavoidable. No machines can replace Human Resource in utilization the available resources effectively. In this competitive market, every organization ensures that it has an effective and efficient Human Resource Development that supports to achieve every objective. The HR department works very hard in utilization of every available human resource to realize the organizations by linking it with the policies and strategy. The HR department also helps the employs understand and respect the values of the organization by constantly conducting activities that involve the employee from every level in the organization. Every large scale firm activity needs to be supported by different departments integrated into one which leads to as a group activity and finally it becomes a coordinated activity carried out at various levels to achieve the organisational goal. Therefore, these strategic objectives can be achieved only with effective human resources management which is controlled by HR department. In the assignment, we have given to carry out research into the HR policies carried out by Tesco. COMPANY PROFILE Tesco is the biggest super market in UK. It has been dominating in British retail sector with domestic market share and global sales. It initially caters in food and later expanded its area of business like clothing, electronics, financial services and telecom. So the Tescos has set up the store namely Tesco extra, Tesco metro and Tesco express in order to meet the customers needs. Since Tesco is considered a one stop retail outlet that has covered every segment of market in the country and it shows Tesco has a great number of manpower. This shows how the HR strategy has been implemented. HUMAN RESOURCE MANAGEMENT Three key HRM activities carried out by Tesco are: Recruitment and pay revision. Training and development. Providing healthy work atmosphere. (See appendix-1) Recruitment, training and healthy work environment are the three key HRM activities carried out by Tesco which I would like to discuss. Recruitment is the process of new employment which is consists of important steps. Some of the important steps involved in recruitment are call for application, criteria allocation, short listing, interview, salary negotiation and offer of employment. Its all about acquiring more human resource as per requirement which can be met in different ways like open day recruitment, application through own website, from agencies on contractual basis, interview from campus and finally internal job posting (IJP). Every job offer should be incompliance with the rules and regulations. Some of the important rules and regulations are: Equal Pay Act (1970). Sex Discrimination Act (1975), Race Relations Act (1976), Disability Discrimination Act (1995), Employment Protection Act (1978). Tesco plc is one of the organizations in the UK that follows very strict procedure of recruitment with aware of various acts. Every different position has its own unique procedure. Most of the selection is done through online system like customer support agent and its immediate higher level appointments and so on. Before any direct interview the candidate is short listed by an online procedure by general aptitude test. Then those who pass the test are called for interview thereby saving time and energy from both sides. Direct application is also available in store which helps in the same way. For higher management positions, there are a few ways like appointing external agencies and direct reputed institutions and also through internal job posting. Once the right candidate is selected the next process is training where the potential of candidate is transformed with the help of available resource to convert them into standard employee. Generally there are two types of training available namely process training where the candidate is made aware of the process his/her duties. The second is on the job training. This is carried further once management feels that employee is able take his responsibilities. So every step is carefully studied and overlooked by HR department in order to ensure the efficiency. Every large scale organization provides training to their employees so does the Tesco plc. Tesco plc ensures that new employee is carefully nested into the organization. They provide training with a payment options and other facilities to the fulltime employees. Tesco plc always demands proficiency among its employees. It also carries out the different programmes like personality development and career advancement options available from time-to time in order boost their morale. Providing healthy work atmosphere is another challenge for the HR department. As we know the world is global village so we can see multicultural society and it is not easy for them to mix into the crowd that they may feel not welcoming. So the HR department duties to make sure these things are discussed and evaluated among the employees before they come on board. Personal Health and Safety is also important issues which needs to addressed by the HR department very cautiously. Better work environment encourage employees to perform their best and to provide better work atmosphere is another challenge for any organization. Tesco plc is aware of this fact. So it ensures that every single employee is aware of his/her rights within the organization. Tesco plc provides more opportunities like part-time and weekend jobs where most of the students are encouraged to work. Though it can be complicated but Tesco plc ensures that this is carried out carefully with the help of HR department. It is the responsibility of HR department to ensure that proper shifts are allocated and there is no confusion among the employee. So these are the reoccurring issues which HR team have to handle it with great care. Tesco plc prohibited the consumption of alcohol and other related products within the premises in order to ensure the safe working atmosphere. This reflects the capability and vision of Tesco plc to provide better work conditions for its employees. Assessing the effectiveness of the Tesco Approach In the era of globalization, every organization like Tesco plc must keep itself along with other organizations on being globally competitive. So employee involved in the organization must be competitive so that they can achieve competitive advantage. The analysis of HR management is based on the different activities carried out. The different activities of HRM that are going to be analysed here are recruitment, training and safety. Tesco plc is one of those organizations that thrive for customer satisfaction and retention. Providing the best prices to stop the customer going anywhere else is the main objective of Tesco plc. For this, Tesco needs to be aware of prices, quality of products, facilities and most important is customer service. For better customer service, the employees need to be trained time-to time. Not every employee joins the company with ample experience and customer skills. So they need to be developed from scratch for a few. Tesco plc is providing employment to stu dents and other part time employees which could help to regulate cost of production. This is vital factor since Tesco plc trying to reduce cost by introducing customer new low price products. It also encourages employee to work close to their homes in order to save the time which makes life easy for all. In addition to these, employees are allowed to opt for transfer that will help to keep loyal to the organization i.e. low labour turnover. Training employees reveals the involvement and dedication of any HR department of organization. Training is cost incurring process which is difficult to afford once it is not utilised economically. So the HR department has to be careful in providing the right training to the right candidate in the organization. As earlier discussed, training could be of two types i.e. process training and on the job training. The main components of Tesco plc training procedure are: Core skills programme fundamental training which helps to deal with customer. Winning in Europe- designed especially for countries other than UK. Excel programme- ranges from fundamental to manger training programme. Training procedure is carried out to perfection in the Tesco. Training with pay and training alongside senior experienced employees provide the best work atmosphere for the best performances. Tescos long-term strategy is to continue with training to employee and to integrate this into culture of the organization. So it always emphasis on staff training and to integrate this learning in the organization. So when employees are trained and showing a higher commitment to the organization which make them feel as part of the overall strategy. Finally, this leads employees feel valued and results a more committed workforce Safety at work is criteria that Tesco management insists to be accounted for in the best possible means. Disaster management and other safety training are provided to employee at no extra charges. This is the contribution that organization makes to the benefits of employees career, a certain advantage. Prohibition of intake of any alcohol related products or any form or drugs unless prescribed by doctor is another step taken by Tesco plc to ensure safety of fellow employee and the customer. Two HRM model For any organization to perform its task efficiently and achieve its common objectives, the people are the utmost important resources to the management. The two approaches have been developed namely hard approach and soft approach. There are two models of activity has developed which I would like discuss in relation to Tesco plc. They are as follows: Harvard model Michigan model The Harvard model was developed in the year 1984 by group of academics. This model is also referred as soft HRM which emphasizes on more human side. According to this model human are not only resources but also a human. There are four main HR policies which are very important in order to deal with people. Firstly there is employee-influence which is inclusive of power, delegation and responsibility with purpose and interest of management. The second is the element of human resources flow i.e. recruitment, selection, placement and promotion, job security, career advancement and termination of employment. The next is rewarding system such as pay and motivation like bonuses, insurances and flexible working hour. The reward should be always align with the overall organizational strategy. Finally work system which deals with the arrangements of people, information and technology i.e. right man in right job with depending upon the skills. (See appendix-2) The Michigan model was developed by Fombrun, Tichy and Devanna in the year 1984. This model is known as hard HRM which is focus on human resource which should be used and exploited fully in order to achieve organizational goals. Here people are treated as a means of achieving the organizations strategy. It also assumes that HRM will respond to the external and internal environment. Basically this model concentrates on managing human assets by motivating and rewarding them in order to achieve companys goal. (See appendix-3) The Harvard model emphasizes on human formulation with HR elements and is considered as the soft aspects of HRM. The soft aspect of HRM is related with human relation whereas the hard aspect is seen as emerging from the business strategy and policy. On the other hand, the Michigan model focused on the human resources strategies and structures in order to improve the companys performances. It considers human resources as key resource of the organization. These two models are the most commonly use HRM models in business today. Based upon the above analysis it can be concluded that the soft model is advisable to be practiced within the service sector while manufacturing sector would be better to use the Michigan model of HRM for increased production. Tesco and its Approach towards HRM Tescos approach towards its HR policies and practices demonstrated the both approaches i.e. soft and hard version of HRM. Tesco is continuously invest on human resources i.e. employees empowerment, participation of employee in management. Tesco also ensures that each employee has the opportunity to understand his or her individual role in contributing to the its core purpose and values which require commitment with an innovative induction programme. Tescos human-resources strategy revolves around work simplification, challenging unwritten rules, achieving steering-wheel targets. It also emphasise on higher level of training to all employees which results in higher commitment to the organization. This highlights the way in which Tescos business measures are closely linked to hard and soft version of HRM Critical analysis of HR performance at Tesco Analysis of performance of any process plays a key role in the development of any organization. As a result of this analysis, various HR plans and policies can be evaluated in order to find out the effectiveness i.e. drawbacks. Recruitment, training and development of employee calibre and also providing best working condition with suitable growth opportunities has been met with high standard. Apart from these, keeping track of the best performance of employee and providing them with opportunity for overall growth and retaining them has been carried out successfully. The analysis shows that the HR department has been performing to the required level of standard in the existing market. We can see the Tesco plc management style of recruitment is strong enough in order to maintain low cost with highly effective training which consists of senior employees as well. Tesco plc also have been using the external agencies to recruit the employees in order to ensures quality recruitment. Tesco p lc ensures the employee is recruited in lines with the national minimum wages or above minimum wages to pay. They also offer the job to those student who wants to work as a part time or weekends which would meet both i.e. organization and student goal. Every employee is aware of his/ her positions and duties to be carried on which is primary activity of HR department. A job description is handed out in order to make aware of task to be performed by each individual employee. The payment procedure is also responsibility of HR department and Tesco ensures that they follow the national minimum wages act. And also there is an alternative feature that is periodical increment in the payment and evaluation based on the performance. Safety of the employee is the prime concern for the HR of Tesco plc which is met with extreme cautiously. They are trained to help themselves in the event of any unfortunate incidents or accidents like fire or theft. This is all to ensure safety among the employee and establish morale. This kind of Tescos method really helps the individual learning preference. This further complicates the role of HRD, balancing organizational needs with the individuals expectations. Employees will vary from each other. So its HR duty to organize right people in right job and this will help to sustain competitive advantage. CONCLUSION The role of human resources in any organization is very crucial in order to achieve organizational goal. The study of Tescos HR policies has focused on level of training provided to all employees i.e. an effect in the bottom line which leads to more commitment among the employees. The study carried out on the different activities of a general HR department and that of Tescos explain that Tesco has been highly successful in implementing the suitable plan and programme. So this helped Tescos to increase their market share and retail units over the years which have been achieved partly through effective HR department although it is not sole factor in their path to success but it has certainly been a major factor of Tesco plc.
